The Process Of Filing For Divorce

Every case will be different when it comes to filing for divorce. At the same time, there are some divorce laws that are applicable regardless of the area you are filing in. For instance, the state and possibly the county is who legally finalizes a divorce with a decree. This document that contains all the terms and conditions, including child custody, property division, support, alimony, and so on.  

Divorce papers will be filed at the court house in you area, either by you or a divorce lawyer. All the financial information between you and your spouse must be presented so issues can be settled fairly, such as child support.

Also, a list of all the assets in the marriage will have to be prepared. The courts will use this as a way to divide the assets fairly between the two parties. Of course, the two parties could decide for themselves how they should be divided and avoid the courts all together. This is known as an uncontested divorce.

This type of divorce is far less expensive and time consuming compared to a contested divorce. This is due to the fact that all the terms have been agreed to, which negates the need for court proceedings and possibly lawyers. However, the chances of everything being agreed to is not very high, but is possible if both parties truly want to go down this path. Both must be able to communicate with each other openly, and the relationship has to be healthy enough to work together.

A question that many have about divorce is whether an attorney is necessary or not. While it’s not required, having one there by your side can make a big difference. A lawyer will be there to answer questions and help you make the right decisions, in addition to drawing up paperwork and filing it for you.

If you aren’t sure how to go about hiring an attorney, ask someone who has been through a divorce who they chose. The people around you may know some attorneys or have an idea of where to start. Otherwise, you simply must research lawyers yourself and contact references to see who is best. You can always select a law firm with a good reputation, knowing that you will get representation.
